Much of this Privacy Policy is divided into sections based on how you may interact with Zemanta. Determine what type of user you are. For each type of user we explain what information we collect and why, what cookies and other similar technologies we use, how we share that information and what your rights are.

We want to understand which services on our websites are of interest to you and we want to remind you about the services we offer when you are not on our websites.   • Sharing information we learn about you on our websites

Generally, we do not share personally identifiable information about you with third parties for third party marketing or promotional purposes. However, we use various third-party providers (each listed in thiscookie table) to help us market or advertise you. For example, some of the cookies we use on our websites are owned by third parties who help Zemanta market or advertise to you. We require these third parties and companies to agree to keep any information shared with them confidential and to use the information only to fulfill their obligations to us. We do this by entering into agreements with all third parties who process personal data on our behalf to ensure that they process your personal data in accordance with our strict instructions and all applicable data protection laws.

  • Use of third party services on our websites.

Our websites may contain links to other websites that we do not own or operate. We do not control, recommend or endorse the content, products, services, privacy policies or practices of these third party websites. For example, you will see clickable icons on our websites that will take you to Zemanta's Facebook page or Zemanta's LinkedIn page. If you click on these links, please note that Facebook and LinkedIn may send their own cookies to your device and independently collect personally identifiable information. If you do this, you can also delete all cookies that we place on any device you use to access our website. If you have provided your email address when using our websites, every email you receive from Zemanta will contain an "unsubscribe" option.

For visitors from the European area, Zemanta implemented a consent management platform (developed byOneTrust) on our websites, which enable visitors to choose whether or not to accept cookies and similar tracking technologies on our websites. When you access our websites, you will see a banner at the bottom of the page with information about the cookies we use. You can click the banner to refuse non-essential cookies. Business partner:You are a business partner when you register (or email Zemanta) on behalf of the company you work for to use the Zemanta control panel or any of our other services.

(a) What information we collect and why

You may provide certain personally identifiable information (such as an email address) when you register for the Zemanta Services or when you communicate or interact with us. If you apply to become an Associate, we may ask you for additional information through advertiser request forms, insertion orders, and other forms. We automatically collect information about your username's actions in the Zemanta control panel.

We collect and process the above personal data in order to fulfill our obligations under our contract as a business partner (or prospective business partner) with you, including:

  • to respond to your questions and requests;
  • to provide you with access to certain functions and features of our Zemanta Services (e.g. to provide and maintain your Panel account);
  • Confirm your identity;
  • Communicating with you about your account, our products and available promotions relevant to your use of the Zemanta Services.

(d) Your Rights

If you, as a business partner, would like to review, correct, update or request opt-out of your information, you can access the Zemanta panel, edit your profile settings or contact us atayuda@zemanta.com🇧🇷 When you receive emails from Zemanta, you can "unsubscribe" via a link in the email. Please note that unsubscribing will not remove notifications that are critical to the provision of Zemanta services (e.g. email bills).

Zemanta's legal basis for processing business partners' personal data is contractual.

Zemanta Users:You are a Zemanta user when you visit a page of a website or application that uses Zemanta technology to serve advertisements ("Zemanta“).

(a) What information we collect and why

We collect the information below automatically through tracking technologies such as cookies, pixel tags, beacons and embedded scripts. We may also infer or collect additional information about you based on what we or our partners collect. Information is shared in the programmatic buying process via Open RTB (see ourglossaryFor more informations.)it isThe information helps us provide our services and show you advertisements that are more relevant to your interests.

Information Collected Automatically

Identifiers: Zemanta Online Identifier, (UUID) Advertiser ID and IP address. The Zemanta UUID and/or Advertiser ID is a string of numbers and/or letters. This UUID connects to your device and varies depending on the browser used. In other words, Zemanta records a different UUID depending on the device and/or browser you use when accessing publishers' websites. This means, for example, that you have one UUID when you visit a website from your mobile phone using the Safari browser and a different UUID when you visit a website from your iPad using the Safari browser. Zemanta combines and consolidates a UUID from a mobile device (laptop or tablet) from a browser, which then accesses an application (or vice versa) from the same device.

Information about activities on the Internet or other electronic networks

  • Page URL
  • Browser information (e.g. Safari or Chrome)
  • Device information (e.g. MacBook)
  • Network operator information (e.g. WiFi, 4G or cable connection)
  • Mobile application information (e.g. application name or IDFA)
  • User interactions with ads published by Zemanta (e.g. the user interacted primarily with travel content)

Geolocation Information:

  • Inaccurate Geolocation Data: On the web and mobile web, we collect inaccurate country and/or city-level location information derived from the user's IP address.
  • Precise geolocation data: in mobile applications, if a user opts for geolocation in the publisher's application, the user's precise geolocation (latitude/longitude) can be passed through the mobile application to the Zemanta SDK; However, Zemanta does not use this information to provide relevant services. Advertising to users (although this information may be stored in raw data logs).

(b) What cookies and other similar technologies we use.

  • Cookies

Cookies are a small string of characters that Zemanta uses to uniquely identify a browser and device. Zemanta synchronizes these cookies with its partners to identify users in all settings and to know in which segments our partners identify our users. Please look at thiscookie tableSee "Zemanta Users" for a detailed list of the first-party cookies used by Zemanta when you interact with the websites that use Zemanta.

  • Pixel-Tags

Pixel tags are transparent images or short Javascript snippets that Zemanta partners and customers use to understand how their users interact with their online properties, including websites and mobile apps.

Zemanta advertisers can implement the Zemanta pixel on their websites. The Zemanta pixel determines whether the user accessing the page where the pixel is installed has a Zemanta UUID. If a UUID is associated with this end user, Zemanta allows advertisers to redirect these UUIDs and/or provide advertisers with the total number of UUIDs that landed on this page. If there is no Zemanta UUID on the page, the Zemanta pixel will not collect any information about the user.

Advertisers are encouraged to advertise using the Zemanta pixel on their own websites. Zemanta does not combine pixel information with a UUID profile.

  • mobile advertising identifiers

Mobile advertising IDs (e.g. IDFA) are unique IDs assigned to individual mobile devices. Users can reset them by instructing their device to do so.

  • General web analysis

Zemanta integrates with its client and partner web analytics software to monitor how users behave after clicking ads. Any data collection by web analytics software is subject to that customer's and/or third party's privacy policy.

  • Zemanta-Client-Technologies

Zemanta's customers and other third parties using Zemanta's Services may use their own tags, pixel cookies or other technologies (or those of their other affiliates) in their advertisements and on certain websites. In such cases, you will be governed by their privacy policy.

(c) How We May Share Information

Zemanta may share some personal data (e.g. Zemanta's UUID, device ID and IP address) with certain partners for cookie synchronization purposes or due to technical requirements. Third parties may determine your identity by using the information we disclose to them together with other information in their possession.

Zemanta may share some personal information with the following categories of trusted third parties:

  • supply-side platform;
  • data management platform;
  • Exchange; me
  • ad networks.

(d) Your Rights

  • Zemanta Exclusion

You can unsubscribe from Zemanta's personalized recommendations at any time. Deactivation means that Zemanta will no longer collect data as long as you remain deactivated. You can turn off personalization on your desktop and mobile webhere.

Please note that you can disable personalized in-app recommendations via your device settings (e.g. by following the instructions for iOS devices and for Android devices).

IMPORTANT– even if you have unsubscribed from Zemanta:

  • You keep seeing ads.Opting out of Zemanta tracking does not mean that you will no longer receive advertising. Rather, it means that ads are not interest-based or targeted based on your browser's cookies.
  • The opt-out is cookie-based and device/browser specific.If you surf the Internet with multiple devices and/or browsers, you must disable each device and/or browser to ensure that personalization tracking is prevented on all devices. For the same reason, you will need to opt out again if you buy a new device, change your browser, or remove (or delete) your opt-out cookie. Disabling personalization tracking is not the same as blocking cookies.
  • To ensure that the profile associated with your UUID is removed, please log out of Zemanta for at least 21 days.Your deactivation will take effect immediately. However, if your browser allows local storage and you opt-in to Zemanta's personalized recommendations within 21 days of opting out, your old profile may be reconnected to your UUID. If you do not cancel your subscription within 21 days, your profile will be deleted and cannot be restored.
  • As with most opt-out cookies, opting out of the Zemanta browser is dependent on a cookie.The opt-out cookie is intended to be persistent to respect user preferences. However, the Smart Tracking Prevention feature in iOS11 can affect the persistence of cookies on websites after a 24-hour period. We recommend using a different browser or blocking all third-party cookies from your browser so that you can "opt-out" without having to rely on a company's actual opt-out method.
  • Additional Opt-Out Opportunities.

You may also opt out of receiving personalized advertising served by us or other advertising companies through industry tools such as NAI and/or EDAA.www.youronlinechoices.eu🇧🇷 If you visit the NAI or EDAA consumer choice pages, you may opt out of some or all participating member services. As with Zemanta's opt-out, these opt-outs do not mean that you will no longer receive advertising; The ads just don't suit you. You may still receive ads, for example based on the specific website you are viewing (i.e. contextual ads). If your browsers are set to refuse cookies when you visit EDAA's consumer choice pages, opting out may not be effective.

3. How We Secure Information, Transfers Outside the EEA, Sharing and Retention

Zemanta has a dedicated security team. We maintain strict controls over the personal information we collect and store it in firewall-protected databases with strictly limited and controlled access rights to ensure its security. We take appropriate technical and organizational measures to protect the information we collect about you from loss, misuse, unauthorized access, disclosure, alteration, destruction and any other form of unauthorized processing.

Business Partners have access to certain password-protected features of the Zemanta Service. You are responsible for keeping this password confidential. Please remember that, unfortunately, the transmission of information over the Internet is not completely secure. A common online scam is known as "spoofing" or "phishing". This happens when you receive an email from what appears to be a legitimate source requesting your personal information. Please note that we will not send you emails asking you to confirm your credit card, bank details or any other personal information. If you receive an email that appears to be from us requesting such information, please do not reply to or click on any links in the email. Forward the email to us insteadlegal@outbrain.com, as we will investigate cases of possible fraud on the internet.

Data transfers outside the EU/EEA

When we transfer personal information from the European Economic Area to other countries where the applicable laws do not provide the same level of data protection as in the European territories, we take steps to ensure an adequate level of data protection. In other words, your rights and protections remain with your data. For example, we use approved contractual clauses and other measures to ensure that recipients of your personal information protect it.

Exchange

In addition to describing how we may disclose your personal information to each type of user, we may also disclose personal information as follows:

  • Within the group of companies controlled by Outbrain Inc (parent company of Zemanta Inc) for internal reasons, primarily for business and operational purposes;
  • When we go through a business transition, such as B. a merger, acquisition by another company, or sale of all or a portion of our assets, your personal information will likely be among the assets transferred;

The retention period of each of the cookies used by Zemanta (own or third party) is indicated in thecookie table.

Zemanta also maintains a data retention policy which details the retention period for personal data based on our analysis of how long certain data is reasonably required for legal or business purposes. When we no longer need personal information, we securely delete or destroy it. Aggregated data that does not identify a device/browser (or person) and is used for reporting and analysis purposes is retained for as long as commercially necessary.

4. Kinder

None of our Services are directed to children under the age of 16. We do not knowingly collect personally identifiable information from children under the age of 16. If, upon collection, we determine that a website visitor, user or business partner is under the age of 16, we will not use or store their personally identifiable information. If we become aware that we have inadvertently collected personal information from a child under the age of 16, we will use reasonable efforts to delete that information from our records. If you are a child, please go play in the garden, please do not use or interact with Zemanta!

5. Citizens of European territory

In accordance with European data protection laws, in particular the European General Data Protection Regulation (GDPR), Zemanta offers citizens of the European territories specific additional rights such as the right of access, rectification, right to object, right to complain, right to removal and right to block. More accurate:

  • the right to request information about whether and which personal data we process and the right to request the correction or modification of personal data.
  • in certain circumstances, the right to request the erasure of personal data.
  • under certain circumstances, the right to request the restriction of the processing of personal data.
  • You can revoke your consent to the processing and use of your data in whole or in part at any time upon further request.
  • You have the right to receive your personal data in a common, structured and machine-readable format.
  • Please contact our data protection officer if you have any questions, comments, complaints or inquiries about our data protection declaration and the processing of your personal data.
  • the right to lodge a complaint with the competent supervisory authority if you believe that the processing of your personal data violates the law.

In addition, in this privacy policy we refer to certain rights of citizens of the European territory. According to the GDPR, citizens of the “European Territories” are the European Economic Area (EEA) and Switzerland. For the purposes of this Privacy Policy, the term “European Territories” continues to include the United Kingdom even after the United Kingdom has left the European Economic Area following Brexit.

As a California resident, you have the rights set out below. However, these rights are not absolute and in certain cases we may refuse your request to the extent permitted by law.

  • Access.You can request a copy of the personal information we have collected about you in the last 12 months.

  • Accept.We contractually prohibit our publishing and advertising clients from placing our technology on sites intended for children under the age of 16. If we learn that you are under 16, we will ask your permission (or, if you are under 13, your parent's or guardian's permission) to sell your personal information before we do so.

    We need to verify your identity and residency in California in order to process your requests to exercise your information, access, or deletion rights. We cannot process your request if you do not provide us with enough details for us to understand and respond to it.

    7. Do Not Track Disclosure

    Some browsers transmit Do Not Track (DNT) signals to websites. Because there is no common understanding of how to interpret the DNT signal, Zemanta does not currently modify, modify or respond to DNT requests or signals from these browsers. We will continue to monitor industry activity in this area and reassess our DNT practices as necessary. In the meantime, you can use the variety of other tools we provide to control data collection and use, including the ability to opt out of personalized recommendations in the Users section.

    8. How you can change this privacy policy

    We may change this privacy policy from time to time. We will post a prominent notice visible to you as a site visitor or business partner, but we have no way of notifying users of an update. You should check here periodically to see if the Privacy Policy has been updated. We always display the date the Privacy Policy was last modified at the top of the page so you know when it was last revised.
